General terms and conditions of business

1. Subject of the brokerage contract

The subject of the contract between PureStone Immobilien GmbH and the client (buyer) is the proof and/or the mediation of the opportunity to conclude a purchase/rental/financing or loan contract with a third party.

2. Commission

All offers from PureStone Immobilien GmbH are subject to commission for the client (buyer). If an express agreement on the amount of commission has not been made, the client (buyer) owes the customary local commission for such brokerage services after successful mediation. The commission is due for payment upon conclusion of the respective main contract with the third party.

3. Content of offers, liability

PureStone Immobilien GmbH receives the information on all offers from the respective owner of the property, the lenders or the sources mentioned in the exposé and any other publications. PureStone Immobilien GmbH assumes no liability for the correctness of the information received from these third parties. All offers are non-binding, subject to prior sale. The liability of Pure Stone Immobilien GmbH and/or the liability for its vicarious agents is limited to grossly negligent or intentional behavior, insofar as the customer does not suffer physical injury or lose his life as a result of the agent's behavior.

4. Disclosure Prohibition

Our information about the contract opportunity is confidential and intended only for the client (buyer). Passing on to third parties is not permitted. In the event of the transfer to a third party not covered by the contract and the causal purchase/rental of the mediation object by this third party, PureStone Immobilien GmbH has a claim for damages against the client (buyer) in the amount of the agreed commission.

5. Permitted Dual Action

PureStone Immobilien GmbH is commissioned by the owner of the property with the sale. She is therefore allowed to act as a broker for both the client (buyer) and the owner of the property.

6. Severability and Jurisdiction

Should one of the above clauses be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

If the client (buyer) acts as a merchant within the scope of the assignment or as a consumer does not have a place of residence in Germany, Berlin shall be the place of jurisdiction and place of performance.

7. Personal Data
